Present and voting were Susanne Stutts, Chairman, Judy McQuade, Vice Chairman, Mary Stone, Secretary, Kip Kotzan, regular member, Art Sibley, regular member

Case 13-24 – Joseph Piecuch, Michele Potvin-Piecuch and the Irmgard J. Ziemba
Trust, 26 Massachusetts Road

A Motion was made by A. Sibley, seconded by J. McQuade to GRANT the necessary variances to allow an addition to enlarge the bathroom and shower area, add an area for washer/dryer/linen closet, as well as an outside shower as noted on plan entitled “Ziemba – Piecuch Residence 26 Massachusetts Road Old Lyme, CT  06371” prepared by Meehan Design Group received September 12, 2013 Sheet A1 of 1 and Site Development Plan dated September 9, 2013 Sheet 1 of 1 got 26 Massachusetts prepared by Angus McDonald Gary Sharpe & Associates, Inc. with following condition:  No solid siding on the outdoor shower, except for the side facing the street [recommended that it not be clapboard].  The reasons to grant are:  1) change in floor area of less than 2%; 2) size of addition has been reduced by 40%; 3) professional survey revealed increase in lot size; 4) numerous letters of approval from neighbors; 5) rear deck has been eliminated; and 6) an effort to modernize a structure with minimum impact, improving safety and functionality.  No discussion and a vote was taken:  In favor:  S. Stutts, K. Kotzan, J. McQuade, M. Stone, A. Sibley  In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0

Case 13-26 C – Mark and Maryellen Phelan, 77 Sea Spray Road

A Motion was made by A. Sibley, seconded by J. McQuade to GRANT Variance application 13-26 C, 77 Sea Spray Road to raise the first floor elevation to elevation as noted on the plan entitled “Proposed Renovations/Additions to Phelan Residence 77 Sea Spray Road Old Lyme, Connecticut” dated 7/15/13 prepared by j.w.Flower architect; and Survey prepared for Mark and Mary Phelan 77 Sea Spray Road Old Lyme, Connecticut Sheet 1 of 1dated 08/28/13 prepared by Compass Land Surveying, LLC for the following reasons:  the foundation will comply with VE construction standards; it technically is FEMA compliant as of the date of the original application and the structure will not exceed 24’ in height. The Coastal Site Plan Review Application is approved as well because it is consistent with all applicable coastal policies and includes all reasonable measures to mitigate adverse impacts.  No further discussion and a vote was taken:  In favor:  S. Stutts, K. Kotzan, J. McQuade, M. Stone, A. Sibley  In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0

Case 13-27 – Cynthia Sepe, 12 Dennis Road

A Motion was made by A. Sibley, seconded by Kotzan to GRANT variance application 13-27, 12 Dennis Road to allow placement of a 14’ x 20’ shed 15’ from the side setback with the following condition:  no electricity, plumbing or heat to shed. The reasons to grant are:  1) topography of lot makes alternative placement impossible and 2)  no impact to adjacent property or neighborhood.  No further discussion and a vote was taken:  In favor:  S. Stutts, K. Kotzan, J. McQuade, M. Stone, A. Sibley  In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0

Case 13-28 – Grace M. Bonola, 22 Clifton Street

A Motion was made by A. Sibley, seconded by J. McQuade to GRANT variance application 13-28, 22 Clifton Street to allow placement of a 10’ x 12’ shed 5’ from the rear property line with the following condition:  no electricity, plumbing or heat to shed.  The reasons to grant are: 1) Because the property does not have a garage or alternate storage, a larger shed is warranted; 2) Secure storage is necessary since a) this is a seasonal property, b) this is a corner lot with exposure and c. there has been previous reports of vandalism in the neighborhood.  No further discussion and a vote was taken:  In favor:  S. Stutts, K. Kotzan, J. McQuade, M. Stone, A. Sibley  In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0

Minutes

A Motion was made by S. Stutts, seconded by A. Sibley to approve the Minutes of the June 18, 2013 Regular Meeting as submitted. No discussion and a vote was taken:  In favor:  S. Stutts, K. Kotzan, J. McQuade, M. Stone, A. Sibley  In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0

A Motion was made by K. Kotzan, seconded by M. Stone to approve the Minutes of the July 16, 2013 Regular Meeting as amended:  page 1, first par., Richard Smith (arrived at 7:42 p.m. “and was seated for second case and the remainder of the meeting”); page 2, first par., “bulkhead is approximately 5 feet by feet” to “bulkhead is approximately 5 feet by 5 feet”; page 7,   first par. change “wondering” to “wandering”; page 7, under 77 Sea Spray change reference to “Mr. Phelan” [since he was not present] to “Mr. Flower”.  No further discussion and a vote was taken:  In favor:  S. Stutts, K. Kotzan, J. McQuade, M. Stone, A. Sibley  In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0

Adjournment

        A Motion was made by K. Kotzan, seconded by M. Stone to adjourn the September 17, 2013 Regular Meeting; no discussion and a vote was taken.  The motion to adjourn passed unanimously.  5-0-0    The meeting adjourned at 8:45 p.m.
